Agenda Item Title:  Positive Work Year Calendar (5 minutes)

Background: 

Mountain View Whisman uses a positive work year calendar with all members of management. The positive work year inhibits members of management from accruing vacation days. Instead, management is provided with a work year (i.e., 224 workdays) out of the year. “Non-work days” are to be taken throughout the year and during the summer months. Due to the impact of Covid-19, members of the districts senior staff team (cabinet) have foregone the use of vacation in order to continue to adjust distance learning plans and develop a path towards reopening. As a result of this, in order to adhere to positive work year guidelines, members of cabinet will either be forced to take a mandate, or they will lose their “non-work” days. 

 

Thus I am requesting that the board approves the following solution:

  1. Allow select members of management (listed below) to increase the number of workdays by ten.
  2. Allow an employee to rollover no more than five non-work days into the 2020-2021 school year.

 

This practice is consistent with our bargaining agreement with 12 month CSEA employees. According to our collective bargaining agreement section 7.3

Vacation time is to be used in the fiscal year in which it is earned. Vacation may, with approval of the supervisor, be taken at any time during the fiscal year. If the employee is not permitted by the supervisor to take his or her full annual vacation during the fiscal year, then the amount not taken shall accumulate for use in the next year or be paid for in cash at the option of the District. (Ed. Code §45197 (d).) The amount of days not taken in any given fiscal year shall not exceed five (5) days (prorated for part time employees), and shall be used not later than the following fiscal year or be paid in cash in July.

Recommended Action: 
That the Board of Trustees approve to 1. Allow select members of management to increase the number of workdays by ten 2. Allow an employee to rollover no more than five non-work days into the 2020-2021 school year.
