Agenda Item Title: Award of Guaranteed Maximum Price (GMP) Contract to BHM Construction, Inc. for Preconstruction, procurement and demolition for the Mistral Elementary School Phase 4 Project (5 minutes)

Background:
At the February 15, 2018 Board meeting, the Board of Trustees approved the Lease-Leaseback delivery method in accordance with Education Code 17406 for the Mistral Elementary School Phase 4 Project.
Through a multi-step process, the District is recommending award of that contact to BHM Construction, Inc. as the contractor providing the best overall value in accordance with Education Code 17406, “Lease-Leaseback” for the Mistral Elementary School Phase 4 Project.
At this time the Board is asked to consider for approval an incremental award of the GMP contract, which includes a 5% owner-controlled construction contingency to complete the pre-construction services work, material procurement and site demolition required for construction of the Mistral Elementary School Phase 4 Project. The approval of the incremental GMP contract will allow the contractor to begin material submittals and procurement along with demolition and removal of the existing temporary campus ahead of DSA approval for the new construction project in an attempt to keep the overall project on schedule for completion of work during summer 2018. Upon approval of the project by DSA, the 2nd increment for the full contract amount will be brought to the Board for approval.
Fiscal Implication:
The GMP contract amount for the Mistral Phase 4 project, increment 1 inclusive of the 5% owner-controlled construction contingency is $1,723,900 with all costs to be charged to Measure G.
Recommended Action:
That the Board of Trustees award the GMP contract and associated Site and Facilities Lease agreements for the Mistral Elementary School Phase 4 Project to BHM Construction, Inc. in the amount of $1,723,900 and authorize the Superintendent to sign the Site and Facilities Lease Agreements.
