Background: 

MVWSD and City of Mountain View pioneer residents have endured construction and access inconveniences in February, March and April, including difficulties with unavailable, shared community amenities and recreational facilities. Staff recommends that the Board approve the implementation of a one-time plan to credit tenants for these inconveniences.  The plan's approach and methodology is as follows:

 

Period covered is from Feb. 21 through June 3, 2025.

  •  The first move-ins occurred on Feb. 21, and have continued incrementally to the present.
  • June 3 is the scheduled final City Building Official walk-through inspection of all of the premises adjacent to the MVW at the Sevens building and grounds.
  • The adjacent facilities include the full menu of shared amenities, underground parking and storage, open spaces, and a public bike path.
  • The outcome of the walk-through and City approvals will trigger full and open access to amenities for all residents of the complex.
  • Some amenities are already open, and others may be completed and opened prior to June 3.
  • The basis of this plan errs in the financial favor of tenants, and assumes all amenities would not be available until June 4.
  • Therefore, June 3 is a date-certain which this plan is tethered to.
  • Should the Board of Trustees approve implementation of the rent credits, current residents will receive varying credit amounts against their June 2025 rent, depending on their move-in dates. (The calculation simply spreads the cost of shared amenities evenly to all apartments, irrespective of the unit type and size.)

 

Contractual context

  • "Affordable Housing Rental Units Agreement" by and among the City of Mountain View, Mountain View Owner LLC (project developer) and MVWSD, dated Sept. 19, 2022.
  • Declaration of Covenants, Conditions and Restrictions and Establishment of Easements and Cost Sharing Obligations for 777 Middlefield Road, dated Dec. 6, 2022. (Commonly called "CC&Rs")

 

Property management procedures

  •  The legal framework above leads to budgeting and sharing of costs for the maintenance of and services for the shared amenities.  Of the total 716 rental units in the project, 144 (20% of total units) are in the MVW at the Sevens building at 699 N. Shoreline Blvd. As such, 20% of on-going costs for shared amenities is to be supported by rental income from the building.

Recommended Action: 

It is recommended that the Board of Trustees approve implementation of MVW at the Sevens Staff Housing Construction Inconveniences Rent Credits, as presented.
