Agenda Item Title: Approve Committee Bylaws for the Mountain View Whisman School District Staff Housing Oversight Committee (15 minutes)

Background:
On May 21, 2019, the Council of the City of Mountain View Whisman approved a Planned Community Permit for a residential rental development consisting of 716 apartment units, including 144 below market rate rental housing units (“Project”) located at 777 West Middlefield Road, Mountain View California with an Assessor’s Parcel Number 153-24-005 (“Property”) to be developed by Mountain View Owner, LLC (“Developer”). The Property consists of a 9.84-acre parcel (“Lot 1”) to be designed, developed, constructed and maintain by the Developer as a market-rate apartment complex with 572 units the Project; and a 1.8 acre parcel (“Lot 2”) to be designed, developed, constructed, operated and maintained as an apartment complex with 144 below market rate rental housing units.
The District and Developer formally agreed the Developer will construct and the District will fund the design and construction of the below market rate rental housing units on Lot 2 (“Teacher Housing Project”) and the District would lease Lot 2 from the Developer for a minimum of 55 years (“Ground Lease”), pursuant to applicable law including without limitation, the Employee Housing Act of 2016 (Health and Safety Code sections 53570-53574). On March 21, 2019, the District’s Board of Trustees approved a Master Development Agreement for Ground Lease and Design, Construction and Management of District Teacher Housing Project between the District and Developer (“Development Agreement”).
The District’s Board of Trustees on August 22, 2024, approved Resolution No. 05-082224 which established the Staff Housing Oversight Committee (“Committee”) to assist the District in operating and managing the Teacher
Housing Project. The Committee will consist of up to seven (7) representative members who will be appointed by the District’s Board of Trustees at a later date at a regularly scheduled Board meeting noticed pursuant to the Ralph M. Brown Public Meeting Act, Government Code sections 54950, et seq. The District now wishes to approve the Bylaws for the Committee.
