Background: 

On November 19, 2015, the District's Governing Board approved Resolution No. 1580.11/15 delegating authority to award contracts to the District's Superintendent, Chief Business Officer, Associate Superintendent(s), and Assistant Superintendent(s) (altogether, “Authorized Individuals”) pursuant to Education Code sections 17604 and 17605 (“Delegation Statutes”). Contracts awarded by Authorized Individuals under the Delegation Statutes shall be “Delegated Contracts.”

 

Delegated Contracts must be ratified by the District’s Governing Board (“Board”), unless they are under the bid limits set forth in Public Contract Code (“PCC”) section 20111, in which case they only need to be reviewed by the Board every 60 days. The bid limits under PCC section 20111 are $15,000 for public projects (“Construction Contracts”) and $114,500 in 2024 (adjusted annually) for equipment, materials, supplies, non-construction services, or repairs, including maintenance (“Non-Construction Contracts”).

 

Therefore, for Delegated Contracts:

 

·       Construction Contracts over $15,000 and Non-Construction Contracts over $114,500 must be ratified by the Board, and

 

·       Construction Contracts under $15,000 and Non-Construction Contracts under $114,500 need only be reviewed by the Board every 60 days.

 

We now present the following contract(s) for ratification and/or review:

 

  1. Achieve Kids - Non-Public School Placement for Special Education Students for the 2024-2025 school year. $240,293.50
  2. Children's Health Council - School Placement for Special Education Student for 2024-2025 school year. $56,875.00

  3. Community School of Music and Art -  will provide Music and Art classes to the State Preschool students. $5,000.00
  4. Creative Learning Center - Non-Public School Placement for Special Education Students for the 2024-2025 school year. $309,859.50
  5. EdFiles - Service to transfer Special Education files to a permanent records retention, comprehensive records classification, organization and management system. $6,687.00 initial set up with annual renewal of $5,988.00
  6. Graham Theater Manager Camille Kelly - Operate and maintain various lighting and sound equipment related to theatrical use for Graham Middle School for the 2024-2025 school year. Not to exceed $15,000.00
  7. Green Room Theater and Dance - will provide comprehensive theater arts progam to Crittenden, culminating in full scale musical production for the 2024-2025 school year. Not to exceed $27,475.00
  8. Santa Clara University - will partner with MVWSD to mentor student teachers enrolled in credentialing programs from July 15, 2024 – June 30, 2027. No cost to the District.
  9. Spectrum - Non-Public School Placement for Special Education Students for the 2024-2025 school year. $132,783.44
  10. Weingarten - Non-Public School Placement for Special Education Students for the 2024-2025 school year. $7,104.00
