Agenda Item Title:  Award of Updated Lease Leaseback Contract for the Multi-Site Window Replacement Phase 2 Contract to EF Brett and Company Inc.

Background: 

At the meeting of the Board of Trustees on March 24, 2022, the Board adopted the procedures and criteria for evaluating  qualifications and proposals of lease leaseback contractors per Education Code 17406 for Measure T Projects.  The procedure and criteria included a best value method for selection of Lease Leaseback contractors.

 

On September 6, 2022, the District issued a Request for Proposals (RFP) for lease-leaseback contractors for the Multi-site Window Replacement Project.   A pre-proposal meeting was held on September 21, 2022 with five (5) firms in attendance. Proposals were due on October 19, 2022.  Three (3) proposals were received. 

 

After review and scoring of the lease leaseback contractor proposals by a panel of District staff and subsequent contractor interviews , EF Brett and Company Inc. was found to be the proposer demonstrating the best overall value for the subject project.  At the Meeting of the Board of Trustees on December 8, 2022, the Board approved the Guaranteed Maximum Price Contract (GMP) for Phase 1 of the project and the preliminary services scope of work for  Phase 2 of the contract and was awarded the lease-leaseback contract to EF Brett and Company Inc.

 

After contract negotiations for the Phase 2 work, the Board is now being asked to approve the GMP Contract for the Phase 2 work.  Because of the modifications for this scope, District staff is asking the Board to approve an updated lease-leaseback contract in lieu of an amendment to the existing contract.  This updated contract will supersede the previous lease-leaseback contract.



Fiscal Implication:

A Guaranteed Maximum Price (GMP) contract in the amount of $16,775,520 which is inclusive of all phases of work will be issued to EF Brett and Company, Inc. which includes construction services for the phase 1 sites (Castro ES, Stevenson ES, Vargas ES and the District Office) and phase 2 sites (Crittenden MS, Graham MS, Bubb ES, Imai ES, Landels ES, Mistrial ES, Monta Loma ES, Theuerkauf ES).  This contract is charged to Measure T.



Recommended Action: 

It is recommended that the Board of Trustees award the updated lease leaseback contract for the Multi-Site Window Replacement Contract to EF Brett and Company, Inc., in the amount of $16,775,520.
