Agenda Item Title:  Third Amendment to the Joint Use Lease Agreement with Action Day Nurseries & Primary Plus at Cooper School Site

Background: 

Action Day/Primary Plus has been a long-standing tenant in the District since 1981.  The current agreement expires June 30, 2023.  Action Day would like to extend that agreement for additional 5 years.

 

The Third Amendment to the Joint Use Lease Agreement would extend the current term to expire June 30, 2028.  The additional 5 years would see an increase in the rent paid.  The third amendment also includes additional rent for a land lease.   The land lease will allow Action Day/Primary Plus to place 7 additional portables.  



Fiscal Implication:

Over a 10 year period, the District will collect from Action Day/Primary Plus approximately $4,340,397.82 in addition to their annual rent of $744,942.76 in 2022-2023.



Recommended Action: 

It is recommended that the Board of Trustees approve the Third Amendment 2023-2028 with Action Day/Primary Plus at Cooper School Site.
