Background:
On February 10, 2022, the District formally bid the Amy Imai Elementary School New Flex Portable Classroom (“Project”) and awarded the contract to Silicon Valley Paving, Inc (“SVP”).
SVP has performed all the work required of it for the Project. However, due to design changes and unforeseen conditions at the Project site, additional work is required to complete the Project. Specifically: 1) the irrigation located under the new portable needs to be re-routed; 2) additional grading work is required to make the field flush with the new paving and provide proper drainage for the area due to an elevation differential; and 3) additional asphalt replacement, repair of the irrigation backflow, and the installation of new sod for the newly graded portion of the field is required (“Additional Work”).
This Additional Work would normally have to be publicly bid unless there is a lawful exception to formal bidding, including a finding by the Board, as indicated in the attached Resolution, that it is futile to publicly bid for this Additional Work. The Resolution approves a change order, directing SVP to perform the Additional Work under the existing contract.
Fiscal Implication:
The contingency monies required for Change Order No. 1 will not exceed $58,248.76.
A summary of Change Order No. 1 is attached. There is $0.00 remaining in the change order contingency for this project.
Recommended Action:
It is recommended that the Board of Trustees approve Resolution No. 02-100622, Declaring the Futility of Public Bidding For Additional Work on the Amy Imai Elementary School New Flex Portable Classroom Project and approving Change Order No. 1 for that work.
