Agenda Item Title: Third Amendment to the Joint Use Lease Agreement with Action Day Nurseries & Primary Plus at Cooper School Site

Background:
The District has a long-standing agreement with Action Day Nurseries & Primary Plus for use of the Cooper Elementary School site for infant care and transitional kindergarten programs. The current agreement expires June 30, 2023. Action Day/Primary Plus would like to extend that agreement for 3 additional years.
The Third Amendment to the Joint Use Lease Agreement would extend the current term to expire June 30, 2026.
Fiscal Implication:
Action Day Nurseries & Primary Plus agrees to pay MVWSD $78.03 per square foot for an annual rent of $744,943. The rent will be adjusted annually on July 1st at a minimum rate of 3% or per the CPI factor.

Recommended Action:
