Agenda Item Title: Notice of Completion - HVAC Modernization and Replacement Project, Foothill Air Conditioning & Heating, Inc.

Background:
On May 6, 2021, the Board approved the construction contract for the HVAC Modernization and Replacement Project from Measure T funds. The Board approved the award of the project to Foothill Air Conditioning and Heating, Inc. in the amount of $4,973,700.00.
On September 9, 2021, the Board approved Change Order No. 1 in the total amount of $8,794.00. Change Order No. 2 is being brought for Board Approval at this meeting in the total credit amount of ($94,831). The final contract amount including Change Orders No. 1 & 2 is $4,887,663.00.
Work on this project is now substantially complete.
Fiscal Implication:
The District currently holds retention in the amount of $244,383.15, or 5% of the final contract value. After a minimum of thirty-five (35) days after the filing of the Notices of Completion with the County of Santa Clara recorder, the District will release the retention amount provided all remaining close out and punch list items have been completed.
Recommended Action:
It is recommended that the Board of Trustees approve the filing of the Notice of Completion for the HVAC Modernization and Replacement Project.
