Agenda Item Title:  Consideration of Approval of Issuance of Notice of Intent to Revoke and Notice of Facts in Support of Revocation to Bullis Mountain View in conformity with Education Code section 47607(e) and 5 C.C.R., section 11968.5.2(d)(1) (30 minutes)

Background: 

On or about March 29, 2019, the District delivered a proposed Notice of Violation to Bullis Mountain View and gave notice of the Charter School’s obligation to respond by refuting or remedying the violations identified therein by May 5, 2019.  On April 4, 2019, the Board approved the issuance of the Notice of Violation.  The final Notice of Violation was delivered to Bullis Mountain View on April 5, 2019.  On April 4, 2019, Bullis Mountain View responded to the Notice of Violation.  However, as explained in the proposed Notice of Intent to Revoke and Notice of Facts in Support of Revocation, substantial evidence exists that the Charter School failed to refute or remedy each of the violations set forth in the Notice of Violation.

Based upon the substantial evidence that demonstrates failure to refute or remedy the violations, District staff recommends the Board approve the initiation of revocation proceedings and issue the proposed Notice of Intent to Revoke and Notice of Facts in Support of Revocation to Bullis Mountain View in conformity with Education Code section 47607(e) and 5 C.C.R., section 11968.5.2(d)(1).  If issued, District staff recommends the Board conduct revocation proceedings in accordance with the following schedule, pursuant to Education Code section 47607(e) and 5 C.C.R., section 11968.5.2(f):

·       June 13, 2019 Board meeting:  Final Decision
